This matter is currently before the court on Defendant Hagemeyer P.P. S. N.A. Profit Sharing 401(k) Plan’s (“Ha-gemeyer Plan”) Motion to Dismiss Plaintiffs Larry Register and Esther Houlihan’s (“Plaintiffs”) Second Amended Complaint (the “Complaint”) for failure to state a claim pursuant to Rule 12(b)(6) of the Federal Rules of Civil Procedure.
