RILEY, Circuit Judge.
Sebastian Rucci (Rucci) filed a complaint in the District Court for the Eastern District of Missouri, requesting that the district court declare Rucci’s real estate unzoned and exempt from any zoning regulations of the City of Pacific (City) and enjoin the City from refusing to process and approve subdivision plans for the property. The City moved to dismiss the complaint for failure to state a claim for which relief can be granted.
