Theresa Pfaff, the wife of Joseph Pfaff, died at St. Peters, in St. Charles county, in June, 1888. On the fifth day of that month John Pfaff, the defendant, was appointed administrator of her estate. He *37took charge of, inventoried and sold as her property certain personal effects, consisting chiefly of furniture and pictures belonging to a hotel which Mrs. Pfaff had conducted and managed for two or three years prior to her death.
