This case comes here on appeal from the circuit court of Cook County, challenging the constitutionality of section 13 of the Illinois Civil Defense Act of 1951. Ill. Rev. Stat. 1951, chap. 127, par. 281.

The State’s Attorney of Cook County brought this quo warranto action against the city of Chicago challenging the legality of certain 1952 appropriations and tax levies for the city’s civil defense fund.
