MEMORANDUM & ORDER

EDELSTEIN, District Judge:

A grand jury sitting in this district handed up an indictment charging the defen dant, David A. Silva, with one count of armed robbery in violation of 18 U.S.C. § 2113(d). Subsequently, the grand jury handed up a superseding indictment charging the defendant with five counts of armed robbery, in violation of 18 U.S.C. § 2113(a); five counts of assault in the commission of an armed robbery, in violation of 18 U.S.C. § 2113(d); and one count of receipt of ammunition in interstate commerce after being convicted of a felony, in violation of 18 U.S.C. §…
