At issue in this removed diversity declaratory judgment matter is plaintiffs motion to remand this case to the Fairfax County Circuit Court for lack of subject matter jurisdiction. Plaintiff alleges that subject matter jurisdiction is lacking because the parties are not fully diverse. Defendant-insurer contends that the non-diverse parties are mere nominal parties whose presence in the case does not destroy diversity. Plaintiffs motion has been fully briefed and argued and accordingly, the matter is now ripe for disposition.
