OPINION

HENDLEY, Judge.

Convicted of attempted first degree murder contrary to NMSA 1978, § 30-28-1, and NMSA 1978, § 30-2-1 (Cum.Supp.1983), and armed robbery contrary to NMSA 1978, § 30-16-2, defendant appeals. The issues raised concern only the attempted murder conviction. Defendant claims 1) jurisdictional error in the instructions given on the crime of attempted second degree murder, and 2) error in the trial court’s failure to give .defendant’s requested instruction on the lesser offense of aggravated battery.
