LATIMER, Justice.

Plaintiffs commenced this action in the District Court under the declaratory judgment section of our statute, seek-v ing to have Section 75-29-21, U. C. A. 1943, of the act designated as “Teachers Retirement Act” (as amended by Chapter 95, Laws of Utah, 1945) declared valid and constitutional, and to have the section as amended interpreted so as to permit them to receive credit in computing retirement benefits for prior services performed as teachers in parochial schools.
