The petitioner herein, administratrix of the estate of James E. Hiney, deceased, seeks an order under article 78 of the Civil Practice Act compelling the Teachers’ Retirement Board to pay petitioner the sum of $4,378.77, being the amount of the accumulated deductions and interest, made from his salary while in the employ of the Board of Education as a teacher.
