HURLEY, Senior District Judge.

Presently before the Court is defendants’ motion requesting that the Court “reconsider and vacate the portion of the Court’s [January 16, 2007] order granting plaintiffs summary judgment on liability, and to instead dismiss these consolidated actions, based on the intervening change in controlling law brought about by the recent decision of the United States Supreme Court in Florence v. Board of Chosen Freeholders, — - U.S.-, 132 S.Ct. 1510, 182 L.Ed.2d 566 (2012).” (Defs.’ Mem. in Supp. at 1.) Plaintiffs have opposed defendants’ application.…
