The defendant Whidden (hereinafter spoken of as the defendant) owned a lot of land adjoining in the rear the plaintiff’s place of business. On April 14, 1913, the defendant and plaintiff entered into a written contract covering the construction of a building on the defendant’s land, and on December 17, 1913, the building at that time being nearly-finished, the parties executed a lease in the form contemplated by the written contract.
