The defendant, Freddie Everett Russell, was convicted of aggravated rape (sexual penetration of a child under the age of 13 years), incest and crime against nature with the same child. The age of the victim was not alleged in the second and third counts but was alleged in the first count. Upon conviction of all three counts, the Trial Court found the defendant to be a Range I Standard offender and imposed a Range I sentence as to each count, each sentence being for a term of 20 years.
