Ronald E. Bowden (claimant) appeals from a decision of the Industrial Commission of Virginia (commission) which denied his claim for workers’ compensation benefits for injuries received during the course of his employment with Newport News Shipbuilding & Dry Dock Company (employer). The commission ruled that his claim was time barred by the provisions of Code § 65.1-87. Claimant asserts that because he received compensation for his injury from employer between October 1984 and April 1987, Code § 65.1-87.1 tolled the limitation provision of Code § 65.1-87, and thus his…
