(Reported below, 5 Lans., 153.) This action was brought to recover for the alleged unlawful conversion of a canal boat belonging to the plaintiff. The only exception available to the defendant in this cause is the motion for a nonsuit at the close of the plaintiff’s case. There are some exceptions set forth in the printed case, which appear to have been made to the mere utterances of the judge in the course of the trial. They are not connected with the introduction of evidence, nor with any proposition in the judge’s charge, so far as the printed case shows.
