1 Reported in 214 N.W. 26. The action was to recover money loaned, the summons and complaint being filed June 5, 1926. The sheriff's return on the summons was that the whereabouts of defendant was unknown and that he could not be found in the state. There was due service by publication. At the time the suit was instituted, an affidavit in garnishment was filed and a garnishee summons issued, directed to and served upon H.R.
