This was an action for damages brought by appellant, hereinafter referred to as “Northwest,” a commercial airline company, against appellee, hereinafter referred to as “Martin,” a manufacturer of airplanes.1 The action was based upon Martin's alleged negligence in the design and manufacture of five “Model 202” airplanes purchased by Northwest, resulting in the loss of one of the planes and the temporary loss of use of four others.
