Michael Marlow was indicted by a Walker County Grand Jury in May of 1986 for burglary in the third degree, in violation of § 13A-7-7, Code of Alabama 1975, and receiving stolen property in the second degree, in violation of § 13A-8-18, Code of Alabama 1975. The appellant was tried before a jury on August 18, 1987. On August 20, 1987, the jury returned a verdict of "guilty of burglary in the third degree." This appellant was sentenced to fifty years' imprisonment in a state penitentiary, pursuant to the Habitual Felony Offender Act.
