I. Background

In 1984, the Guilford County Board of Commissioners (“Commissioners”) adopted its first countywide watershed protection ordinance. At the time, the following watersheds were designated: Greensboro, High Point, Jamestown, Lake Mackintosh, Reidsville, and Pole Cat Creek. In August 1985, the Commissioners designated the Randleman Dam watershed, whose boundaries included a portion of 94.11 acres of property owned by Linda H. and Wolfy Unger, (“defendants”).
