Crane to show cause why an order should not be made requiring him to execute and deliver to petitioner a substitution of attorneys in a certain action then pending and deliver certain documents belonging to petitioner. Eespondent moves to dismiss this appeal on the ground that it was not perfected within the time limited by statute.

The judgment was rendered and entered on October 23, 1917. The notice of appeal and bond were served and filed in March, 1918, but the appeal fee was not deposited with the clerk of the lower court until April 24, 1918, one day after the expiration of the time within which an appeal could be taken.

Section '2 of chapter 66 (p. 80), of the Laws of 1917, after providing for the service of a notice of appeal, further provides: “To render the appeal effective for any purpose…
