MEMORANDUM OF DECISION ON MOTION BY U.S. TRUSTEE TO DISALLOW EXCESSIVE FEE OF DEBTOR’S ATTORNEY

This matter comes before the court on a motion by the U.S. Trustee to disallow retainer fees charged by Debtor’s attorney as excessive in violation of 11 U.S.C. § 329(b). Certain retainer fee amounts which the U.S. Trustee acknowledged to have been earned prepetition or to have been for services which benefitted the estate have been allowed previously, without objection.
