—Judgment, Supreme Court, New York County (Jeffrey Atlas, J.), rendered December 3, 1984, convicting defendant, after a nonjury trial, of murder in the second degree, and sentencing him to a term of 22 years to life, and order, same court and Justice, entered on or about October 17, 1997, which denied defendant’s motion pursuant to CPL 440.10 to vacate the judgment of conviction, unanimously affirmed.
The verdict was based on legally sufficient evidence and was not against the weight of the evidence. There is no basis upon which to disturb the court’s determinations concerning credibility…
