MEMORANDUM OPINION
WANDA McKEE FOWLER, Justice.
Appellant, Juan Carlos Marines, was indicted on the offense of murder. The jury returned a guilty verdict, and the trial court sentenced appellant to forty-five years’ confinement in the Texas Department of Criminal Justice, Institutional Division, and a $10,000 fine. Appellant then filed a motion for a new trial based on “newly-discovered evidence,” which the trial court denied.
