On January 31, 1972, the defendant was indicted for murder in the second degree by the Bennington County Grand Jury. The indictment charged the defendant with the unlawful killing, with malice aforethought, of Ralph Searby on November 25, 1971, at Bennington, Vermont. Trial by jury on March 27-31, 1972, resulted , in a verdict of guilty. The defendant appealed to this Court.
