This action was filed in the Breathitt circuit court by-appellants and plaintiffs below, Ervine Turner, 'Sr., and Samuel Turner, Jr., against appellee and defendant below, Lewis 'Deaton, and in the petition as amended plaintiffs alleged that they owned the title to and were in possession of a described parcel of land in Breathitt county and that defendant had wrongfully entered upon it and taken therefrom timber to the value of $.300.00, and had otherwise damaged plaintiffs to the amount of $100.00, and they prayed for a judgment against him for…
