On January 1, 1985, American Technical Enterprises, Inc. (American), entered in a contract for the purchase of a Hatteras Motor Yacht, the “Gemini Lady,” from Hatteras of Lauderdale, Inc. (Hatteras), a yacht retailer. As a part of this sales contract a substantial amount of customization was to be made to the Gemini Lady prior to delivery. This customization went from refinishing and remounting the port and starboard running lights to fabricating and installing “custom Glass Enclosure for aft salon center to cockpit w/sliding P & S aft windows.” Yacht…
