Affirming.

This is a controversy between the "War Fork Land Company and James Marcum as to the ownership of two tracts of land in Jackson county, one containing one hundred acres and the other a one-half interest in fifty *354acres. In 1860 Philip Marcum obtained a patent to the one hundred acres, and in 1860 a patent was issued to Philip Marcum and George M. Pigg for the fifty acres, and both of the parties to this litigation claim the land under conveyances made by Philip Marcum.
