Shorn of its procedural complexities, this case presents two issues for decision: (1) Should the entire controversy doctrine be extended to compel joinder of parties, and if so, should it be extended retroactively, thus barring a later suit against a tortfeasor intentionally omitted in an original action? and (2) Should an attorney’s tactical delay of thirteen months in serving a summons on the omitted tortfeasor, in violation of the ten day rule, R. 4:4-1, require that the client’s claim be dismissed with prejudice?
