On July 10,1943, two separate informations were filed against defendants charging them with the violation of section 261 of the Penal Code (rape), alleging that on June 26, 1943, each did wilfully and unlawfully and with force and violence have and accomplish an act of sexual intercourse with the prosecutrix. The defendants were duly arraigned thereon. Thompson, in person, and Sourisseau,. through his counsel, entered a plea of not guilty thereto.
