This cause is before the court for resolution of cross-motions for summary judgment filed by the Plaintiff, John Bushouse (“Bushouse” or “Plaintiff’) and Defendants Local Union 2209, United Automobile, Aerospace & Agricultural Implement Workers of America, et al. (“the Union”) on May 15, 2001. The parties concluded briefing on these motions on July 9, 2001, making these motions ripe for consideration.
