Summary judgment was rendered against plaintiff, Guidry, in his third-party action brought against Neches Butane Products Company (hereinafter “Neches”) to recover damages for personal injuries he sustained while in the course of his employment with Foster-Wheeler Corporation (hereinafter “Foster”) while working within the plant of Neches. Foster was made a third-party defendant, and it impleaded as a third-party defendant Tri-Co, Inc. Liberty Mutual Insurance Company, the subrogated workmen’s compensation insurance carrier intervened.
