MEMORANDUM OPINION AND ORDER

On October 29, 1980, the Plaintiff, Rich Mar Apartments, filed a “Complaint to Terminate or Modify Automatic Stay” seeking the ejection of the Defendant Debtor from a residential apartment for non-payment of post-petition rent due under the terms of a lease entered into prior to the filing of the bankruptcy petition. The Debtor filed an Answer on November 14, 1980, and appeared along with counsel at a hearing held on November 26,1980.
