We will refer to the parties as they appeared in the trial court where plaintiff in error’s intestate was plaintiff and defendant in error was defendant.

The action was brought to recover damages for personal injuries allegedly sustained by plaintiff in an automobile accident. Defendant offered no defense on the issue of liability and the case was submitted to the jury for determination of the amount to which plaintiff was entitled to recover.
