We have here a motion by plaintiff for summary judgment upon a cause of action for declaratory judgment. The material facts are undisputed.

*869The defendant, Westchester Joint Water Works No. 1 (hereinafter referred to as Water Works) was organized pursuant to the provisions of chapter 654 of the Laws of 1927, as amended. It is a public corporation formed of three member municipalities, to wit: the Town of Mamaroneck, the Village of Mamaroneck and the Town of Harrison, all of Westchester County, New York.
