The plaintiff was required, as a condition to the commencement of a suit for divorce, to pay to the clerk of Clatsop County a fee of $10. This sum he now seeks to recover as an unlawful exaction, and the single question presented is whether the district attorney or the county is now entitled to such fee. Under Section 1074, Hill’s Ana.
