—In an action to recover damages for personal injuries, the defendant New York City Transit Authority appeals from an order of the Supreme Court, Queens County (Schmidt, J.), dated July 29, 1999, which granted the plaintiffs motion for leave to serve a late notice of claim upon it and denied its cross motion pursuant to CPLR 3211 to dismiss the complaint insofar as asserted against it.
Ordered that the order is reversed, on the law, with costs, the motion is denied, the cross motion is granted, the complaint is dismissed insofar as asserted against the appellant, and the action against the…
