The appellant as plaintiff filed this suit in the circuit court against the appellee for the recovery of damages for personal injuries sustained by him when an automobile in which he was riding in an easterly direction on Capitol Street in the City of Jackson was struck by a new Chevrolet automobile owned by the appellee and driven by one C. T. Butler in a northerly direction on West Street. The appellee-defendant filed a demurrer to the declaration which was sustained by the lower court and the plaintiff, having declined to plead further, suffered a dismissal of the suit and appeals…
