This was an action commenced by defendant in error, plaintiff below, in the district court of Riley county, *121to recover of the railroad company damages for the destruction of a field of rye, caused, as alleged, by the diversion of a natural watercourse. The defendant answered with a general denial, and also that the damages sustained were caused by the act of plaintiff.
