Plaintiff in error was plaintiff below, and defendant in error was defendant below, and we shall refer to them as plaintiff and defendant.

Plaintiff filed suit in the justice court, precinct No. 3, of Kaufman County, against defendant, to recover the value of a hand bag and its contents, alleged to be $139.50.
