LOKEN, Circuit Judge.
During his trial for the felony of conspiring to defraud the Small Business Administration, Eugene Fitzhugh pleaded guilty to a misdemeanor violation of 18 U.S.C. § 215, bribery with intent to influence an official of a financial institution. Months later, Fitzhugh moved to withdraw that plea. The district court denied the motion and sentenced Fitzhugh to one year in prison.
