ORDER GRANTING DEFENDANT’S MOTION TO DISMISS
WIESE, Judge.
Plaintiff, the daughter of a former employee of the United States Department of Interior, now deceased, sues to recover an amount equal to the death benefit payable under her mother’s Federal Employees Group Life Insurance (FEGLI) policy, of which she was the designated beneficiary. Defendant has moved to dismiss on the ground that the complaint fails to allege a breach by the United States of any duty owed by it under the Federal Employees Group Life Insurance Act, 5 U.S.C. §§ 8701-8716 (1982) or the accompanying regulations.
