KIRKPATRICK, Chief Judge.

This is a suit for damages for, breach of contract and unfair competition. The substance of the cause of action is that the defendant, having agreed to transfer to the plaintiff an established library equipment business, refused to carry out certain of its obligations under the agreement and entered into generally unfair competition with the: plaintiff.
