Appeals (1) from an order of the Supreme Court (Kahn, J.), entered September 1, 1995 in Albany County, which, inter alia, denied *776defendant’s motion for summary judgment dismissing the complaint, and (2) from the judgment entered thereon.

Plaintiff Peter Cain (hereinafter Cain) was seriously injured in a hit and run accident while driving his motorcycle in New Jersey.
