Cross-appeals by The New York Life Insurance and Trust Company, as executor, etc., of Charles Saxer, deceased, and by William. P. Fiero, special guardian of the infants, Charles Saxer McCaffrey and others, from a decree of the Surrogate’s Court of the county of Westchester, entered in said Surrogate’s Court on the 29th day of September, 1902, settling the accounts of said executor, and. directing that certain sold securities be replaced or a certain sum charged to said executor.

These appeals involve the construction of. the last will of- CharlesSaxerj who died in June, 1897. The testator directed the payment of his debts and funeral expenses, and gave the residue to the New York Life Insurance and Trust Company, “in trust, nevertheless,, to collect, take and. receive all the rents, income, interest and profits, thereof, and to pay over therefrom to my sister-in-law, Sarah Healy, .the. sum. of, -five hundred dollars yearly during her natural life, in *249equal half-yearly payments, the first payment to accrue at my death, and to pay over the rest of said…
