RAMBO, Chief Judge.

Before the court is Defendant’s motion for summary judgment. The issue has been fully briefed and is now ripe for consideration.

Background

The following facts are undisputed by the parties; any contested points will be noted by the court: In June of 1980, plaintiff Duane Hunsaker began treatment with Dr. Byron Chong for cataracts. On August 28, 1982, as part of this treatment, Dr. Chong performed an intracapsular cataract extraction 1 on Mr. Hunsaker’s left eye, surgery which entailed removing his natural eye lens which was clouded over by the cataract.
