Appeal from Brazoria. This suit was instituted on the 3rd of June, 1845, by the appellant against W. D. C. Hall, on a note and instrument claimed to be a mortgage or lien. The note was as follows : “ $9,645. Brazoria, 2nd December, 1840. “ Twelve months after date, we, or either of us, promise to “ pay Susannah Hall, administratrix of the estate of William “ S. This suit was brought to recover the amount of a note given by the defendant to the plaintiff, on the second day of December, A. D., 1840, and to enforce a lien for the payment of the note aforesaid, on certain negroes named in the petition, for the purchase of which the note was given. There was a general demurrer filed, to the petition, which was sustained by the Court; which is assigned as the first error, by the counsel for the appellant.
