The plaintiff, in 1S23, brought suit before the Superior Court of Georgia, against ;Smith and Turner. Smith being arrested on the jtrocess, entered with the present defendant, Lawrence, into a bail-bond to the ■sheriff, in the penal sum of $480, payable to him, his attorney, successors, or assigns, and conditioned for Smith’s appearance to the suit. This was done under an act of the legislature of Georgia, by which bail in apj>earance bonds, given to the sheriff, are declared to "be deemed and held as special bail, and as such, made liable to the recovery of the plaintiff.
