The appellees, J. T. Sauls and wife, instituted this suif against the appellants, Denton county and road district No. 3 of Denton county, to enjoin them from constructing a public road across a tract of land which was community .property and homestead of appellees. After the suit was brought an agreement was made between appellants and appellees under which the former were permitted to construct the road without the necessity of condemnation proceedings, and the suit could proceed to determine whether appellants had the right to appropriate the land under an agreement signed…
