Affirming.
The appellant, Vess Bowling, has been convicted of the crime of voluntary manslaughter, and sentenced to confinement in the state penitentiary for a term of five years.
Bowling shot and killed Roscoe Howard in the Peoples Hotel in Morehead, Kentucky, on October 3, 1939. Howard rented a room on the second floor of the hotel about 5 o ’clock in the afternoon.
