Affirming.

Elbert Lassiter stands convicted of the crime of manslaughter, and from the judgment sentencing him to confinement in the penitentiary for two years he has appealed.

The indictment charged him with the murder of his father-in-law, Halley G-arner. The first ground urged for a reversal is the alleged error of the trial court in overruling the demurrer to the indictment. The caption of the indictment is “Commonwealth of Kentucky v.
