This action was brought by plaintiff seeking to have title to a half section of land decreed to be vested in him by reason of an implied trust existing by operation of law, or to obtain specific performance of an oral contract relating tp said lands. Plaintiff alleged, in substance, that he was the son of C. M. *86Roberts, deceased; that the defendant was the second wife of C. M.
